Terms of use
Last updated:
This is a translation of the Dutch terms of use. If they differ, the Dutch version applies.
Draft — have this checked by a lawyer before launch
This is a first version. Blocks marked ‘To check’ are points that still need a decision or a review.
In short
- HouseSwipes is free for movers. Partners pay us a fee.
- Showing your home comes with no obligation. Likes, proposals and matches are not binding.
- Estate agents and other partners are independent businesses. What you agree with them is between you and them.
- Be honest and respectful. We can remove content and suspend accounts when needed.
1. About these terms
These terms apply to the use of the HouseSwipes app and this website. HouseSwipes is a service of [BEDRIJFSNAAM] (‘we’ or ‘us’), located at [ADRES] and registered with the Dutch Chamber of Commerce (KvK) under number [KVK-NUMMER].
By creating an account you agree to these terms. Our privacy statement explains how we handle your data. Partners are also bound by the arrangements in their partner agreement.
2. What HouseSwipes is (and is not)
HouseSwipes is an app for homeowners who want to move. You show your own home without having to sell it, you browse other movers’ homes on a map of neighbourhoods, and if you like each other you can chat and hand the sale over to a partner estate agent.
We are not an estate agent, valuer or financial adviser, and we are not a party to the sale or purchase of a home. We do not give advice on prices, financing or the value of your home. Information in the app, such as average prices in a neighbourhood, is an indication.
3. Free for movers
HouseSwipes is free for movers: no subscription, no in-app purchases and no cost to show your home.
We earn our money from partners. Partner estate agents pay us a fee when a sale through HouseSwipes goes through, and other partners may pay us for contacts or appointments that come about through the app. That is why we sometimes introduce you to partners. You are never obliged to work with a partner. What a partner charges you is something you agree with that partner yourself.
4. Your account
- You are 18 or older.
- You own the home you show, or you may show it on behalf of the owner. If you own the home together with someone, make sure they agree.
- You use your real name and an email address and phone number of your own. We verify your phone number with a code.
- You have one account. You keep your sign-in details secret and you are responsible for what happens with your account. If you notice someone else using your account, tell us straight away.
You do not need an account for the demo mode. Everything in it is made up.
5. Showing your home
- Showing your home comes with no obligation. You do not have to sell and you can take your home offline at any time.
- What you say about your home must be correct and up to date. You only post photos of your own home that you are allowed to use.
- Photos must not show recognisable people, documents, valuables or anything that gives away the exact address, such as a house number or street sign.
- We check homes and photos. We can refuse them, ask you to change something or take them offline.
- Others see your neighbourhood and an approximate location. The app only shares the exact address after a match, when the other person opens the conversation. After that, we cannot undo the sharing.
- If you do not confirm for a while that your home is still available, we take it offline. At the moment that happens after 60 days, and we remind you beforehand.
6. Nothing is binding
A like, Super Like, price proposal, counter-proposal, match or appointment in the app is not an offer, not an acceptance and not a purchase agreement. It is a way to show you are interested. Nobody is bound by it.
You only buy or sell a home with a written purchase agreement outside HouseSwipes, usually with the help of an estate agent and a notary. Be honest about your plans and let the other person know if you change your mind.
7. Conversations
- After a match you can chat. Be kind and honest.
- Be careful when sharing your own contact details, and do not share other people’s details without their permission.
- Never pay anything in advance to someone you met through HouseSwipes. HouseSwipes never asks you for a payment.
- An owner can switch off messages for new matches. After a hand-over to an estate agent you can still read the conversation, but no longer write in it.
8. Hand-over to an estate agent
After a match you can hand the sale over to a partner estate agent who works in the area. One of you chooses an agent and requests the hand-over; the other has to agree. Only when you both agree:
- the estate agent receives both your first names and the details of the match (the home, the neighbourhood and the agreed price), but not your contact details;
- you can still read the conversation but no longer write in it, and the home goes offline;
- the estate agent contacts you through the app.
The estate agent is an independent business. Whether you hire them and what that costs is something you agree with the agent yourself; we are not a party to that agreement. If a sale comes about through the agent, the agent pays us a fee. You pay us nothing for it.
9. Partners and coupons
Partners are independent businesses, such as estate agents, painters, removal companies, mortgage advisers and notaries. We choose them with care, but they are responsible for their own services, prices, advice and terms. What you agree with a partner is an agreement between you and that partner.
Your moving boxes may contain coupons from partners, for example a discount on moving or on doing up your home.
- A coupon is personal, can be used once and is valid until the date on the coupon.
- You cannot exchange a coupon for money or sell it.
- The partner sets the exact conditions (shown with the coupon) and checks the code when you use it.
- If a coupon is not accepted or a partner stops, let us know. We will try to sort it out, but we cannot guarantee that a partner will always accept a coupon.
10. Residents’ places
Only residents of a neighbourhood can add places there, post photos of places and react to places. We work out whether you are a resident from the neighbourhood of your own home in the app.
Only add real places that are open to everyone, such as a school, park, shop or stop. No private homes and no recognisable people. We review new places and photos before they become visible. We do not show who added or reacted to a place.
11. What is not allowed
- showing a home that is not yours, or giving incorrect or misleading information;
- pretending to be someone else or a business, or creating fake accounts;
- fraud, phishing or asking people for money (for example a deposit);
- spam, advertising, or approaching people for services HouseSwipes is not meant for;
- harassing, threatening or discriminating against others, or posting hateful, sexual or violent content;
- using other people’s data outside HouseSwipes without their permission, such as an address you received after a match;
- disrupting the app or our systems, getting around security, or collecting data automatically (scraping, bots);
- creating a new account after we suspended or blocked you;
- anything else that breaks the law or the rights of others.
12. Reports and moderation
See something that is not right? Report it in the app: open your conversation with that person, tap ··· and choose Report or block. You can also email [E-MAILADRES SUPPORT], for example about a home, a place or a partner. Blocking hides you from each other everywhere in the app, including the map, and closes open matches.
Our team reviews reports. If something breaks these terms or the law, depending on how serious it is, we can:
- refuse or remove content, or take your home offline;
- give you a warning;
- suspend your account temporarily;
- block your account.
In serious cases, such as fraud or threats, we may inform the police. If we take action against you or your content, we tell you what we did and why, unless the law does not allow it or it would harm an investigation. Disagree? Email us within six months and we will look at it again.
Check which obligations under the Digital Services Act (DSA) apply to HouseSwipes, such as notice and action, statements of reasons, a complaints process and a point of contact, and whether the exemption for small enterprises applies.
13. What you post
What you post on HouseSwipes, such as photos, text, places and messages, remains yours. You allow us to store it, adapt it (for example resize it) and show it as far as needed to make HouseSwipes work. This permission is free of charge and non-exclusive, and lasts as long as it is in the app. Places you added may stay after you delete your account, without showing who added them.
You confirm that you have the right to share what you post and that it does not infringe anyone’s rights. The app, its design, texts, logo and the HouseSwipes name belong to us.
14. Availability and demo
We do our best to make HouseSwipes work well, but we cannot promise the app will always be available and free of errors. Sometimes there is maintenance. We can change, add or stop features, and open or close cities. We will tell you in good time about big changes.
In demo mode all homes, people, partners and coupons are made-up examples. You cannot derive any rights from them.
15. Liability
HouseSwipes brings movers and partners into contact. That is why:
- we are not responsible for what other users or partners post, say or do, or for the accuracy of their information;
- we are not responsible for your decisions about buying or selling a home, or for agreements you make with other movers or partners;
- we are not liable for damage because the app is temporarily not working.
As far as the law allows, we are only liable for direct damage caused by a mistake on our part. These limits do not apply if the damage is caused by our intent or deliberate recklessness, and they do not affect the rights you have as a consumer under the law.
Have the limitations of liability checked against consumer law (including the black and grey lists, articles 6:236 and 6:237 of the Dutch Civil Code) and decide whether a maximum amount should be included.
16. Stopping
You can stop at any time and delete your account: Me tab › Delete account. See the steps on the support page.
We can suspend or end your account if you do not follow these terms. If we stop HouseSwipes, we will let you know well in advance.
17. Changes
We can change these terms. For important changes we will tell you at least 30 days in advance, in the app or by email. If you do not agree, you can delete your account. If you keep using HouseSwipes after that, the new terms apply.
18. Law and disputes
These terms are governed by Dutch law. If you have a complaint, please contact us first; we are happy to look for a solution together. If we cannot agree, you can go to the competent court. As a consumer you always keep the protection that the law of the country where you live gives you.
